(2)  The Minister may grant to the Chief Commissioner leave of absence, other than recreation leave, on the terms and conditions as to remuneration that the Minister determines. However, depending on workload and the volume of reports received, it may take around one month to input the data into the database from when we received the report. (2)   The maximum fee payable to the Commonwealth under paragraph (1) (a) in respect of a staff member’s salary is:                (a)    $1 000 for each full day of attendance; or               (b)    $133.33 for each hour, or part of an hour, of attendance on each day on which the person is not required to attend for the full day, up to a maximum of $1 000. (1)  The Chief Commissioner must not engage in paid employment outside the duties of the Chief Commissioner’s office without the Minister’s written consent. Accidents and serious incidents (commonly called Immediately Reportable Matters), which affect the safety of aircraft must, in the first instance, be notified to the ATSB by telephone toll-free call (24 hour) 1800 011 034. Attendance fees where staff members etc. (a)  setting out any safety issues identified during the course of an investigation that should be addressed; or                     (b)  setting out any steps taken by persons to remedy safety issues identified during the course of an investigation. (2)  The person, association or agency to whom the recommendation is made must give a written response to the ATSB, within 90 days of the report being published, that sets out:                     (a)  whether the person, association or agency accepts the recommendation (in whole or in part); and                     (b)  if the person, association or agency accepts the recommendation (in whole or in part)—details of any action that the person, association or agency proposes to take to give effect to the recommendation; and                     (c)  if the person, association or agency does not accept the recommendation (in whole or in part)—the reasons why the person, association or agency does not accept the recommendation (in whole or in part). (a)    taking, catching or capturing fish for trading or manufacturing purposes; or               (b)    processing or carrying fish that are taken, caught or captured.

(a)  an Australian defence aircraft; or                     (b)  an Australian defence ship; or                     (c)  an exempt foreign aircraft; or                     (a)  Australia and a foreign country; or                     (b)  Australia and 2 or more foreign countries.Note:          See also section 49 which allows the ATSB to declare that a recording is no longer an OBR. (1)  Subject to subsections (2) and (3), the Chief Executive Officer may, by writing, delegate to any person all or any of his or her powers under this Act.Note 1:       Functions and duties can also be delegated: see the definition of Note 2:       For variation and revocation, see subsection 33(3) of the              (2)  The Chief Executive Officer must not delegate his or her powers under this Act to anyone other than:                     (b)  a person who holds or performs the duties of an APS Executive Level 2 position. (4)   Subject to subregulation (5), in relation to a particular ship, this Part applies only in relation to matters occurring during the period:                (a)    beginning when the first person to board the ship for the purpose of performing duties as a crew member does so; and                (b)    ending when the last crew member to disembark from the ship does so.

(1)   For the purposes of the definition of                 (a)    subject to subregulation (2), the death of, or a serious injury to, a person on board the ship concerned or in contact with the ship or anything attached to the ship or anything that has become detached from the ship;               (b)    the ship being lost, presumed lost or abandoned;                (c)    the ship suffering serious damage, or the existence of reasonable grounds for believing that the ship has suffered serious damage;               (d)    a fire (even if subsequently extinguished), smoke, fumes or an explosion on or in any part of the ship;                (e)    the loss of a person from the ship;                (f)    the ship being stranded or disabled;               (g)    the ship being involved in a collision;               (h)    the ship nearly being stranded or involved in a collision;                (i)    contact between the ship and another object, including a wharf or buoy, resulting in the other object being seriously damaged or destroyed;                (j)    the ship suffering a significant loss of stability to the extent that the safety of the ship is, or could be, seriously endangered;               (k)    any other matter in relation to the operation of the ship that a reasonable person would consider seriously endangers, or, if not corrected, would seriously endanger, the safety of the ship, its occupants or any other person. Sections 1 and 2 and anything in this Act not elsewhere covered by this tableThe day on which this Act receives the Royal AssentA single day to be fixed by Proclamation, subject to subsection (3)Note:          This table relates only to the provisions of this Act as originally passed by the Parliament and assented to. (1)   This regulation is made for subsection 18 (1) of the Act and applies to an immediately reportable matter of a kind referred to in regulation 2.3 (air transport operations). (1)  The Chief Commissioner may enter special premises without the occupier’s consent and without obtaining a warrant if:                     (a)  the Chief Commissioner believes on reasonable grounds that it is necessary to do so; and                     (b)  the investigation is an investigation into an immediately reportable matter. (a)  a ship registered in Australia under the                      (b)  an unregistered ship that has Australian nationality under section 29 of that Act; or                     (c)  a ship owned by the Commonwealth, a State or a Territory. (2)  The ATSB may, at any time before an investigation has been completed, publish, by electronic or other means, a report in relation to the investigation if it considers that the publication of the report is necessary or desirable for the purposes of transport safety. (5)  The person presiding at a meeting of the ATSB has a deliberative vote and, if the votes are equal, also has a casting vote.
